I wanted to share this policy change with you so you can inform the providers of the change in policy regarding how we are addressing scheduling of annual surveys and issues of noncompliance.
Because the STAR Rating Certificate is based on a survey of the fundamental areas as defined by statute, we cannot abstain from surveying particular rule areas or not cite noncompliance because the county has. This would create an inaccurate rating and would create an inequitable perspective dependent on the county's dedicated resources and diligence to regulatory activities in adult care homes. Because of the coordination problems we have experienced in scheduling annual inspections relative to county activities, we are unable to reschedule based on the a facility's outstanding citations issued by the county. If outstanding citations exist and are also cited during an annual survey, the PoC submitted for the citations in a Corrective Action Report may also be submitted for the citations in our Statement of Deficiencies, if appropriate.
Our process is to conduct annual inspections based on our inspection process and to cite noncompliance based on identified scope and severity based on survey results. If the facility has an outstanding citation or violation, we will review it at the time the statement of deficiencies is being finalized to ensure that penalty proposals would note or refer to the county's if the same findings exist relative to the same period of noncompliance. This will be done by management in coordination with team members and the relevant county staff. To avoid scheduling an inspection until we are notified that compliance is achieved is not of service to residents or consumers. |
